Minutes from August 8th Meeting
Regular City Council Meeting
October 10, 2006
7:00 p.m.
Cumberland City Council met in regular session with Mayor Douglas Towne presiding. Mayor Towne called the meeting to order at 7:00 p.m. Council members present were: Clarke Gerlock, David Meyer, Jason Rouse, Robert Hershberger, and Lela Mae Lank. Also present were city employees Ron Benton and Rebeka Gerlock. Visitors in attendance: MJ Broomfield and Jerry Putnam.
Motion by Gerlock, second by Lank, to approve agenda with addition of “PRIDE Homeownership Assistance Program” under New Business. All ayes, motion carried.
MJ Broomfield and Jerry Putnam explained the purpose of the PRIDE Homeownership Assistance Program. The Council will act on this at the next regular council meeting.
Motion by Rouse, second by Meyer, to approve bills in the amount of $24,687.62. All ayes, motion carried.
The following committee reports were presented:
• Clerk- reviewed ICAP visit; request to set up an account with an office supply company
• Streets/Sidewalks- need to get salt for this winter
• City Maintenance- tractor has a fuse problem
• Animal Control- received complaints about dogs running loose
• PRIDE- had a meeting Oct 5 in Anita, discussed the Homeownership Assistance Program and impact for PRIDE communities; trying to organize a Housing Committee
Under old business, the city attorney will remain J.C. Van Ginkel, with no retainer fee and a $100 per hour rate.
Motion by Hershberger, second by Lank, to set the date for Halloween on Tuesday, October 31st, from 5-7 p.m. All ayes, motion carried.
Motion by Meyer, second by Gerlock, to approve the Street Finance Report. All ayes, motion carried.
Motion by Meyer, second by Hershberger, to purchase four new tires for the city pick-up truck. All ayes, motion carried.
Under correspondence, Jyl Waters of SCORE sent a Thank You note to the Council after the recent SCORE event.
Upon motion by Rouse, second by Lank, the city council meeting adjourned at 8:55 p.m. All ayes, motion carried.

Regular City Council Meeting
September 12, 2006
7:00 p.m.
Cumberland City Council met in regular session with Mayor Douglas Towne presiding. Mayor Towne called the meeting to order at 7:00 p.m. Council members present were: David Meyer, Robert Hershberger, Lela Mae Lank, and Clarke Gerlock. One council vacancy. Also present was city employee Ron Benton. Visitors in attendance: Don & Betty Drager, Cecil Boos, Brad Penton, Julie Edwards, and Jason Rouse.
The Oath of Office was administered to Clarke Gerlock by Mayor Towne.
Motion by Hershberger, second by Meyer, to appoint Jason Rouse to fill the council vacancy until the next general election. All ayes, motion carried. The Oath of Office was administered to Jason Rouse by Mayor Towne.
Agenda approved with addition of Library update. Motion by Meyer, seconded by Lank, to approve consent agenda with the addition "Mayor requested council to fill both vacant city council seats." All ayes, motion carried.
Motion by Hershberger, second by Meyer, to approve bills in the amount of $12,585.23. All ayes, motion carried.
The following committee reports were presented:
• Clerk- New computer purchased and will need to purchase an additional program
• Finance- the August bank statements and financial statements prepared by clerk balanced
• Fire Department- purchased 3 new fire suits; requested payment for the balance of a bill; also requested city to enforce ordinance that requires house numbers on all residences.
• Streets/Sidewalks- Street resurfacing project ended $800 below budget; received complaints on wet grass being dumped on streets. Hershberger will visit with party responsible.
• City Maintenance- Need new tires on pickup before winter and will check on prices
• Landfill- DNR is giving requirements for upkeep of landfill. Gave a reminder that no tax dollars are used to operate.
• Library- Julie Edwards gave report about recent grant received, the library’s new web site, and a goal to achieve a Tier 2 certification.
Hershberger suggested putting abatements on hold until an attorney is hired.
One letter needs to be sent to a property owner to mow per city ordinance.
Under other business/citizen forum, clerk is to check with League of Cities on volunteers working for the city and implications to insurance coverage. Meyer will talk to city attorney regarding intentions for further city business. A committee was formed for further city attorney needs consisting of Hershberger, Meyer, and Gerlock. Council also discussed unauthorized charging to the city's accounts.
Upon motion by Meyer, second by Gerlock, the city council meeting adjourned at 9:11 p.m. All ayes, motion carried.

November Council Minutes
Regular City Council Meeting
November 14, 2006
7:00 p.m.
Cumberland City Council met in regular session with Mayor Douglas Towne presiding. Mayor Towne called the meeting to order at 7:00 p.m. Council members present were: Clarke Gerlock, David Meyer, Jason Rouse, and Lela Mae Lank. Absent: Robert Hershberger. Also present were city employees Ron Benton and Rebeka Gerlock. Visitors in attendance: Russ Miller, Dawnelle Humbert, and Vicki Anstey.
Motion by Meyer, second by Gerlock, to approve agenda. All ayes, motion carried.
Mayor Towne read a proclamation honoring Jennie Gerlach’s 100th birthday on November 18, 2006, and making the same day “Jennie Gerlach Day”.
Vicki Anstey with the Cumberland Public Library updated the council on current library board members, classes taken by the librarian and board president, and upcoming events. Meyer made a motion to have the library board find candidates for the board membership when vacancies occur. Lank seconded, all ayes. Motion carried. The City Council would then approve candidates for the library board. The Library budget will need to be amended to add a line for Donations/Gifts, which was tabled until the December meeting.
School parking issue on 4th street was discussed with property owner. The owner has plans to move one camper and will be notified when the school will be having special events so that the camper(s) may be moved for the day.
Mayor Towne opened the public hearing about the FY06 Annual Financial Report at 7:49 p.m. for comments. No comments were made for or against said report. Mayor Towne closed the public hearing at 7:50 p.m.
Motion by Meyer, second by Rouse, to approve consent agenda. All ayes, motion carried.
Motion by Rouse, second by Meyer, to change the agenda and add the bills to the consent agenda. All ayes, motion carried.
Mayor Towne appointed Jason Rouse to Mayor Pro Tempore, Lela Mae Lank to Enforcement Officer, and Clarke Gerlock to Finance Committee with Dave Meyer.
Discussion of the sale of the ballfield was held. A citizen is interested in purchasing the ballfield from the City. A reminder was made that the C & M School District has the first right of refusal.
The following committee reports were presented:
• Clerk- upcoming meeting dates were given; a request was made for two handbooks useful to the clerk and council
• Finance- checkbook balanced for the month of September
• City Maintenance- water tower will need painted soon
• Streets/sidewalks- sand was purchased for the winter
• Landfill- pursuing new requirements to head off closure
• Animal Control- received complaints about dogs running loose
• PRIDE- next regular meeting will be December 7 at 7 p.m. in the Cumberland Fire Station. The 2nd part planning session for P.R.I.D.E’s future will be December 1 at 5:30 p.m. at Harrisdale Homestead.
Motion by Meyer, second by Lank, to approve resolution #2007-2 RESOLUTION APPROVING FISCAL YEAR 2006 FINANCIAL REPORT. All ayes, motion carried.
Motion by Gerlock, second by Meyer, to partner with P.R.I.D.E. and approve resolution #2007-3 RESOLUTION AUTHORIZING THE CITY OF CUMBERLAND TO PARTNER WITH P.R.I.D.E., INC. IN AN APPLICATION TO THE FY2007 IOWA HOUSING FUND PROGRAM FOR A HOMEOWNERSHIP ASSISTANCE PROGRAM. All ayes, motion carried.
Pursuing property at 216 Adams will be tabled until the December meeting.
ICAP visit was reviewed by clerk and council will be taking further action at the December meeting.
Clerk has prepared a letter to send to residents that do not have house numbers on their homes. Numbers may be picked up free of charge at the City Hall.
Motion by Gerlock, second by Meyer, to approve bills in the amount of $14,463.14. All ayes, motion carried.
Upon motion by Rouse, second by Lank, the city council meeting adjourned at 9:49 p.m. All ayes, motion carried.

Minutes of December 06
Regular City Council Meeting
December 12, 2006
7:00 p.m.
Cumberland City Council met in regular session with Mayor Douglas Towne presiding. Mayor Towne called the meeting to order at 7:02 p.m. Council members present were: Clarke Gerlock, David Meyer, Jason Rouse, Robert Hershberger, and Lela Mae Lank. Also present were city employees Ron Benton and Rebeka Gerlock.
A bill in question was moved to the end of the agenda for further discussion. Two items were added under Other Business: discussion of an abatement and a DOT Grant for city beautification. Minutes need addition of Mayor’s report: “Mayor led discussion of the sale of the ballfiled and presented a bill for the ballfield in discussion; and made committee seat changes.” Motion by Meyer, second by Gerlock, to approve agenda. All ayes, motion carried.
Motion by Hershberger, second by Rouse, to approve the consent agenda with bills in the amount of $11,534.43. All ayes, motion carried.
The following committee reports were presented:
• Mayor- encouraged the council to continue working together
• Clerk- went to a meeting and has one of the handbooks previously ordered
• Finance- checkbook balanced for the month of October
• Fire Department- dinner theater went well; reported on several fire/ambulance calls; preparing for sesquicentennial in 2009
• Streets/sidewalks- reminder of the snow ordinance and updated on vehicles parked on the street
• City Maintenance- lightning storm hit several places and took out transformers and fuses and remote head on pump
• Landfill- progressing on Subtitle D; update on employee status
• Animal Control- received complaints about dogs running loose
• PRIDE- reported on last meetings
Update was given by Ron Benton about the Community Building’s roofing project. Community Boosters have met and agreed to put a new roof on the Community Building. Discussed budgeted amounts and city’s contribution to the project.
A proposal will be made to present to the library about the public/library restroom cleaning responsibility. This proposal will be ready for the Library Board to discuss at their next meeting.
Usage of the back room in library was discussed as well as the possibility of the library receiving a grant to expand. The City Council would like to have a joint meeting after the first of the year with the Library Board to discuss possible issues of expansion.
Motion by Hershberger, second by Gerlock, to have Bruce Rogers post the city ordinances on the city website for informational purposes only. All ayes, motion carried.
Motion by Rouse, second by Lank, to amend the library budget to account for $1000 for gifts and donations, active and proactive for Fiscal Year 2007. All ayes, motion carried.
Plans for the ballfield in the upcoming year remains unchanged. Discussed changed to the lease agreement.
Update on back taxes given about property at 216 Adams.
Budget preparation will begin this month. Council is to prepare and plan for projects to be done in the upcoming fiscal year.
Under other business, several abatement questions were addressed. Motion by Meyer, second by Rouse, to put bill from Stamp Construction on hold until City Hall receives the date on which work was done. All ayes, motion carried.
Lank presented a possible DOT grant to help beautify Iowa. Council would like to pursue the possibility of this grant.
