Regular City Council Meeting
February 10, 2009
7:00 p.m.

Cumberland City Council met in regular session with Mayor Julie Edwards presiding. Mayor Edwards called the meeting to order at 7:00 p.m. Council members present were Clarke Gerlock, Dave Meyer, Steve Porter, and Lela Mae Lank. Absent: Michelle Lange. Also present were city employees Ronald Benton and Pat Becker. Visitors: Jon Huggins, Chris Karns, Teresa Stender, and Ericka Stender.

Motion by Lank, second by Gerlock to approve meeting agenda with additions under Discussion Items (C) change to Cigarette License approved for Tobacco Outlet, 112 A Main St. and addition of (H) to approve FY10 Budget Estimate. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.

Motion by Lank, second by Gerlock to approve consent agenda with February bills in the amount of $14,038.83 and correction to February minutes to approve renewal of Liquor License with addition of Sunday Sales for Rusty Wire. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.

Under the Citizen Forum, concerned citizen willing to offer their time to upgrade building at 107 Main St. Council felt a certified abatement letter should be sent to owner.

Mayor Edwards opened the public hearing at 7:13 p.m. No comments were given. Mayor Edwards closed the public hearing at 7:14 p.m.

Brocker Karns & Karns reviewed ICAP and spoke on the fidelity bond/audit recommendation.

Council reviewed the City’s Sex Offender Ordinance because of a citizen complaint. Motion by Meyer, second by Porter to check with Attorney if person is in violation of our ordinance. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.

Motion by Meyer, second by Gerlock to grant cigarette permit refund, if any, for Middle of Nowhere for prorated amount and Tobacco License approved for Main St. Tobacco Outlet which will pay a prorated amount for cigarette permit. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.

Motion by Meyer, second Gerlock allow Cumberland 125 committee to close streets during their summer celebration for activities and parking, also, giving permission to beautify sidewalks with planters. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.

Council reviewed the recommendations from ICAP and IMWCA. Motion by Lank, second by Gerlock to adopt Resolution #10-2009, for seatbelt policy and RESOLUTION #11-2009, for designated physician policy. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.


Motion by Meyer, second by Porter to allow Donna Edwards to City Hall garage area for pictures during Cumberland 125 celebration.

Motion by Gerlock, second by Porter to have Midwest Tree Service grind and cleanup tree stump in park. Ayes: Gerlock, Meyer, Porter, Lank. Lange absent. Motion carried.


Motion by Gerlock, second by Meyer to approve Resolution #9-2009, for FY10 Budget. Roll call vote. Ayes: Gerlock, Meyer, Porter, Lank. Nay: None. Lange absent. Motion carried.

The following committee reports were presented:
 Mayor – citizen request for band in backyard, telephone proxy
 City Clerk- Homeland Security grant
• Finance Committee – water loan
• Streets / Sidewalks – Blacktop Service
• P.R.I.D.E. – meeting Mar. 14 Marne-Legislative Coffee, April in Massena – date to be announced
Correspondence/other business – discussion of City Hall plaque update.

Upon motion by Gerlock, second by Porter, the city council meeting adjourned at 9:18 p.m. All ayes, motion carried.
